Rakesh Kumar Goyal, Proprietor of M/s Mohini Food Product, filed a petition under Section 9 of the Insolvency and Bankruptcy Code, 2016, as an operational creditor.

The operational creditor claimed a net amount of Rs. 1,42,46,178/- along with interest of Rs. 28,58,480/- was due from the corporate debtor.

The corporate debtor, Shri Paramsukh Edible Foods Pvt Ltd, is a private limited company incorporated on 3rd February, 2020.

The applicant claimed to have supplied Mustard Seeds to the respondent, with 8 invoices raised between 05.08.2021 and 31.08.2021 remaining unpaid.

The corporate debtor argued that the debt amount was not in default, there was no agreement on interest payment, and the e-way bill address was incorrect.
