The Appellant issued a demand notice under Section 8 on 21.10.2022 for Rs 8.23 Cr. with interest @18% due to non-payment.
The Corporate Debtor replied on 31.10.2022 denying outstanding dues and raising deficiencies in the Operational Creditor's performance.
The Operational Creditor filed a Section 9 application on 22.02.2023, which was rejected by the Adjudicating Authority on 23.10.2023.
The Appellant contended that the Adjudicating Authority failed to consider that invoices for the Vanijya Bhawan Project fell outside the Section 10-A period.
