This Writ Appeal concerns a dispute over the applicable customs duty rate on imported Crude Palm Oil of Edible Grade. The respondent, Ruchi Soya Industries Ltd., imported the goods, and the appellants, Union of India and customs officials, sought to apply a higher duty rate of 12.5% based on Notification No.46/2015-Cus. dated 17.09.2015. The respondent contended that the earlier Notification No.12/2012-Cus. dated 17.03.2012, prescribing a 7.5% duty, should apply. The learned Single Judge ruled in favor of the respondent, quashing the reassessment and holding the respondent liable to pay duty only at 7.5%. The Union of India appealed this decision.
